Divorce

Initiating the Process: Should you wish to commence divorce proceedings, please contact our office to schedule an appointment. We will discuss all available options with you and require the following documents to proceed: 1) Copy of your ID; 2) Proof of residence; 3) Copies of birth certificates for all minor children from the relationship; and 4) A copy or the original Marriage Certificate. Following the consultation, we will proceed accordingly, addressing any questions or concerns you may have.

Opposed Divorce: If your spouse has initiated divorce proceedings and served you with a summons, it’s crucial to act promptly. You have 10 business days to respond. Upon receiving the summons, please contact our office to arrange a consultation. Bring along the necessary documents, including your ID, proof of residence, and the Summons served. We will assess the situation, discuss implications, and guide you through the process for the best possible outcome.


Arrangements regarding the Minor Children

Should disagreements arise regarding visitation rights or custody arrangements for your child(ren), we can assist in drafting a parenting plan to reach a middle ground and formalise it through a court order.

Changing Matrimonial Systems: Couples may apply to the court to change their matrimonial system at any time. Success in this endeavour depends on valid reasons for the change, adequate notification to creditors, and ensuring no prejudice to other parties. If these criteria are met, the court will grant permission for the change, allowing the couple to enter into a notarial contract to formalise their new choice.


Relocation applications of minors between provinces of the RSA or abroad

 In South Africa , relocation applications involving minors — whether abroad (international relocation) or between provinces (domestic relocation) — are sensitive and can be complex matters that fall under the jurisdiction of the Children’s Act 38 of 2005 and the Constitution.

When one parent does not agree, a court application is required to resolve the dispute in the child’s best interests.
